Processing of specific categories of personal data for archival public interest, scientific or historical research purposes or statistical purposes
If special categories of personal data (Article 9 GDPR) are to be identified, there must be an important public interest in the investigation, and it must be ensured that the personal data of the controller for the investigation are processed only by persons who are subject to obligatory confidentiality with respect to the subject matter of the investigation or whose reliability is otherwise credible.
Processing of data relating to criminal convictions and offenses
The third main section (§§ 36 to 61 DSG) regulates the Austrian implementation of the directive (EU) 2016/680 to protect natural persons during the processing personal data by the responsible authorities for the purpose of prevention, investigation, detection or prosecution of criminal offenses or to carry out sentences as well as for free data traffic.
In the implementation, as far as possible, reference has been made to the regulations in the GDPR.
