Structure of the Austrian supervisory authority
In Austria, in accordance with Art. 51 GDPR, the ‘Data Protection Authority’ (DPA) was established as the supervisory authority.
The Head of the Data Protection Authority is appointed by the Federal President for a period of five years based on a nomination from the Federal Government; reappointment is permitted. This individual must have certain qualifications, such as have a law degree, personal and professional qualifications and have at least five years of legal professional experience.
The Data Protection Authority has a monocratic structure, is independent due to European law and international law and is not subject to any administrative or technical supervision.
